SHEEO State Authorization Surveys

Revision of Montana University System from Tue, 04/22/2014 - 09:44

1A1. Agency Name:
Montana University System Office of the Commissioner of Higher Education
1A2. Agency Description - Please review the description below and revise as appropriate (e.g., state executive agency, agency with appointed board, department or division within agency, etc.):

Degree-granting institutions must get the Board of Regents’ approval, and must be accredited by one of the six regional accreditation agencies recognized by the Montana Board of Regents or by the Council on Higher Education Accreditation (CHEA), and documentation of accreditation must be provided. There is no separate State agency in Montana that regulates, licenses, or oversees proprietary schools, but the educational and business requirements for State Authorization are the same, as set forth by Statute and by the Montana Board of Regents.

None. The Montana Secretary of State has statutory responsibility for business registration determinations for private for-profit and not-for-profit institutions.
1C2. If the division of responsibility among these agencies is not clear, please explain:

Not applicable. We have worked with the Secretary of State to determine the meaning of “regularly carrying on business” via the internet for distance learning.
